On the 11th of November 2002, in the name of victims of apartheid, an international court action against banks and businesses, the so-called Khulumani complaint, was filed in New York. The action concentrates on specific histories of 91 apartheid victims and on the role of banks and businesses which with their activities propped up the apartheid state and aided and abetted serious crimes against humanity. Abweisung der Apartheidklagen durch New Yorker Richterin

„That these plaintiffs are left without relief in an American court is regrettable. But I am bound to follow Kiobel II and Balintulo, no matter what my personal view of law may be.“
Mit dieser ungewöhnlichen persönlichen Erklärung leitete Richterin Scheindlin vom New Yorker Bezirksgericht am 28. August 2014 ihre Zurückweisung der von ihr selbst eingeforderten Neufassung der Klageschrift von Apartheidopfern gegen die beiden US-amerikanischen Firmen IBM und Ford ein.

After twelve years of sustained advocacy towards ending the impunity of transnational companies for aiding and abetting the perpetration of gross human rights violations in South Africa, through their collaboration with and provision of military and other strategic equipment to the security agencies of the apartheid regime, the presiding judge, Shira Scheindlin has ruled that ATS jurisdiction following Kiobel II no longer extends “to claims involving foreign conduct by foreign subsidiaries of American corporations.” In the Khulumani case, all the conduct in question relates to conduct by subsidiaries of the American parent companies, Ford Motor Company and IBM.

Südafrika: US-Gericht weist Apartheidklagen zurück

“The dismissal of the cases, after so many years, once again leaves open and unresolved, the unfinished business of the Truth and Reconciliation Commission,” said advocate Dumisa Ntsebeza, former Truth and Reconciliation Commissioner.
Am 21. August hat das 2. Appellationsgericht in New York die Klagen zurückgewiesen, welche Opfer von Menschenrechtsverletzungen im Jahre 2002 gegen international tätige Konzerne wegen deren Komplizenschaft mit dem Apartheid-Regime eingereicht hatten. Das Gericht stützte sich dabei auf die Argumente, welche das Oberste Berufungsgericht der USA im April 2013 gegen die Anwendung des Alien Tort Statutes bei extraterritorialen Handlungen im Fall Kiobel vs. Royal Dutch Petroleum Co. angeführt hatte.

Khulumani Support Group: JOINT PRESS RELEASE - US CIRCUIT COURT DISMISSES APARTHEID

On Tuesday, 21 August 2013, the 2nd Circuit Court of Appeal dismissed the South Africa Apartheid Lawsuit. The basis of the dismissal was the argument that “the Alien Tort Statute does not reach the extraterritorial conduct in this case”, a judgment of the US Supreme Court of Appeals in the Kiobel v Royal Dutch Petroleum Co. case, handed down in April 2013. After the Kiobel judgment, US-based companies may no longer be held accountable for human rights violations that did not take place within the United States.

Zuma-Regierung unterstützt Entschädigungs-Klage der Apartheid-Opfer in den USA (Pressemitteilung)
„Die südafrikanische Regierung ist jetzt der Ansicht, dass dieses Gericht ein geeignetes Forum für die Anhörung der verbleibenden Klagen wegen Beihilfe zur Verletzung des internationalen Rechts ist,“ schreibt der südafrikanische Justizminister Jeffrey Radebe am 1. September 2009 in einem an Richterin Shira Scheindlin vom New Yorker Bezirksgericht gerichteten Schreiben.

New Yorker-Richterin lässt Apartheidklagen zu

Mit ihrem am 8. April veröffentlichten Entscheid hat die New Yorker Richterin Shira A. Scheindlin die Klagen von Apartheidopfer gegen internationale Unternehmen, die mit dem Apartheidregime geschäfteten, gutgeheissen. Die KEESA (Kampagne für Entschuldung und
Entschädigung im Südlichen Afrika) ist aber über diese Zulassung der Klagen erfreut und hofft, dass damit ein wichtiger Schritt getan werden konnte, damit die Apartheidofper endlich zu ihrem Recht und zu Wiedergutmachung kommen.

Apartheidklagen – ein erfreulicher Erfolg vor dem Obersten Gericht

Einmal monatlich versammeln sich die aktiven Mitglieder von Khulumani, einer Selbsthilfeorganisation von Apartheidopfern, um sich u.a. über die neusten Entwicklungen bezüglich ihrer Klage informieren zu lassen. Gross war der Jubel, als sie im Mai erfuhren, dass das Oberste Gericht der USA den Entscheid der Vorinstanz gutgeheissen hatte und die Klagen gegen 23 internationale Konzerne und Banken unter dem Alien Tort Claims Act (ATCA) damit rechtskräftig zugelassen sind. Das bedeutet, dass sich das New Yorker Bezirksgericht jetzt materiell auf die insgesamt drei Entschädigungsklagen einlassen muss.

Schweizer Regierung und Konzerne müssen zu ihrer Verantwortung stehen

Die Kampagne für Entschuldung und Entschädigung im Südlichen Afrika (KEESA) mit Sitz in Basel begrüsst den Entscheid des Obersten US-Gerichts, die Klagen zugunsten der Opfer des südafrikanischen Apartheid-Regimes im Umfang von über 400 Mrd. US-Dollar zuzulassen.
Die Klagen der Apartheidopfer-Organisation Khulumani und weiterer Kläger richten sich unter anderem gegen die beiden Grossbanken UBS und Credit Suisse sowie zahlreiche internationale Konzerne, darunter Nestlé, Holcim, Novartis und Ems Chemie.

Wichtiger Erfolg für Apartheidklagen 

Das Appellationsgericht in den USA hat am 12. Oktober einen grundlegenden Entscheid zugunsten der Apartheidklagen gefällt. Es hat die Abweisung der Klagen durch Richter Sprizzo vom November 2004 aufgehoben. Damit haben die Apartheidopfer einen wichtigen Erfolg erkämpft und sind ihrem Ziel nach Gerechtigkeit einen Schritt näher gekommen.

Globale Gerechtigkeit – Apartheid-Klagen gegen Konzerne

Am 11. November 2002 wurde in New York eine Klage im Namen von Apartheid-Opfern gegen 22 westliche Unternehmen eingereicht, darunter die Schweizer Banken UBS und Credit Suisse. Den Beklagten wird vorgeworfen, durch ihre Unterstützung des Apartheid-Regimes in Südafrika zu schweren Menschenrechtsverletzungen beigetragen zu haben. Im November 2004 ist die Klage in erster Instanz abgewiesen worden; gegenwärtig läuft die Berufung. In Südafrika selber gibt es eine heftige Auseinandersetzung um die Klagen, und sie könnte ein Präzedenzfall zur Weiterentwickelung des internationalen Völkerrechts werden.
Ich möchte deshalb ganz kurz ein wenig den historischen Hintergrund der Apartheid skizzieren. Dann sage ich etwas zur Entwicklung von neuen menschenrechtlichen und völkerrechtlichen Vorstellungen, und komme schliesslich konkret auf die Apartheid-Klagen zurück. Das soll immer auch mit Seitenblick auf die Schweiz geschehen.

Tutu supports victims’ claim (pdf)

TWELVE Truth and Reconciliation Commissioners are backing apartheid victims in a court battle seeking compensation from more than 20 multinational companies — which are being supported by the South African government.

Desmond Tutu, the chairman of the TRC, told the court that he “would support the right of victims to seek redress in any country in the world where courts do have … jurisdiction”.

Plaintiffs state claims for apartheid, a human rights violation that also constitutes a crime against humanity. The District Court erroneously concluded that even a state actor who directly supported apartheid would escape civil liability. The court focused narrowly on the Apartheid Convention and the failure of the major powers to ratify it and ignored or erroneously rejected sources of customary international law which support plaintiffs' claim. This Court should clarify that apartheid is a violation of the law of nations and a crime against humanity, and that plaintiffs may proceed with their claims against corporate defendants for aiding and abetting the acts of apartheid against plaintiffs.

International Human Rights Case

The Court of Appeals in the District of Columbia in the United States of America has decided against compensation for women who were victims of the Japanese war crime known as the "/jugun ianfu/ scheme" during World War II. These women have also been referred to as "comfort women".
Khulumani Support Group has been reliably informed that this judgement cited the Maduna affidavit as one of the reasons why the "comfort women" appeal was dismissed. The Maduna affidavit was submitted on behalf of the South African government to the New York court in June 2003, in opposition to the apartheid lawsuits. Khulumani is convinced that the South African government did not intend that the Maduna affidavit should be used to thwart cases of war crimes, such as the one. (whole text see pdf)
